These Terms of Service ("Terms") govern your access to and use of the services provided by Cascade Financial Solutions LLC ("Cascade," "we," "us," or "our"), including the ARIA AI voice agent platform, our website, and any SMS or voice communications delivered through our platform (collectively, the "Services").

By using our Services or providing your contact information to a business powered by ARIA, you agree to these Terms. If you do not agree, please do not use our Services.

1. Description of Services

ARIA is an AI-powered voice agent that businesses use to manage inbound and outbound phone calls, schedule appointments, send appointment reminders, and communicate with their customers. As a customer of an ARIA-powered business, you may interact with ARIA via phone call or SMS text message.

2. SMS Communications

Consent to Receive Messages

You receive SMS text messages from an ARIA-powered business only if you agree to them. During a call, after your appointment details are confirmed, ARIA asks how you would like to receive your confirmation. If you choose text message, ARIA tells you that message and data rates may apply and asks for your permission before collecting your mobile number. Your consent covers messages about your appointments with that business: booking confirmations, appointment reminders, rescheduling and cancellation notices, and service status updates. Our SMS Messaging Program page describes the consent script, sample messages, and message frequency.

Consent to receive SMS messages is not a condition of purchasing any product or service.

Opt-Out

You may withdraw consent and stop receiving SMS messages at any time by replying STOP to any message. You will receive one final confirmation message, and no further messages will be sent to your number unless you re-subscribe by replying START.

Message and Data Rates

Message and data rates may apply. Message frequency varies based on your appointment activity. Cascade Financial Solutions LLC is not responsible for any charges applied by your mobile carrier.

No Guarantee of Delivery

SMS delivery depends on your mobile carrier and network conditions. We are not liable for undelivered, delayed, or misdirected messages.

3. Acceptable Use

You agree not to:

• Provide false or inaccurate information when scheduling an appointment or interacting with ARIA.
• Attempt to manipulate, deceive, or abuse the ARIA system.
• Use our Services in any way that violates applicable local, state, national, or international law or regulation.
• Harass, abuse, or threaten any person through our platform.

4. Intellectual Property

All content, software, and technology comprising the ARIA platform — including the ARIA name, voice, and interface — are owned by or licensed to Cascade Financial Solutions LLC. You may not copy, modify, distribute, or reverse engineer any part of our Services without our express written permission.

5. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

6. Limitation of Liability

To the fullest extent permitted by law, Cascade Financial Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services — even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or our Services shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date when we do. Continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California.
